Time Deposits for Individuals

Is an electronic system, which facilitates searching, comparing and selecting the most convenient option of services rendered to individuals.

**Term:**
- in case of deposit in AMD or USD: 31-1095 days
- in case of deposit in EUR or RUB: 31-730 days

in case of deposit for a period exceeding the established maximum term, the terms of the deposit may be established on a contractual (individual) basis

- **Minimum deposit amount:** 30,000 AMD, 100 USD/EUR, 3,000 RUB

In case of exceeding the deposit amount, the deposit terms may be set on a contractual (individual) basis. 

- Interest payment frequency: monthly or at the end of the deposit term

**Interest capitalization:**

The deposit can also be invested with the option of monthly interest capitalization. In this case, the calculated interest is credited to the deposit balance according to the selected interest collection frequency. In this case, the annual interest rates specified in this summary in accordance with the interest collection method are applied.

**Interest calculation:**

The Bank calculates interest on a daily basis from the date the Deposit is received by the Bank until the day preceding its return to the Depositor or its withdrawal from the Depositor’s account on other grounds. Moreover, the Bank calculates the interest rate for each day, taking the ratio of 1/365 days as the dividing basis (and for leap years the Bank uses the ratio of 1/366). Interest is calculated on the actual balance of the Deposit.

Conditions

- To place a term deposit at the Bank's branches or at the "Nalbandyan" service center, the Depositor presents to the Bank an identity document and a public service number (social card) or a certificate of non-existence (not required in case of presenting an identification card). 
- To place a term deposit, the Depositor must have/open a bank/card account with the Bank. 
- The amounts of commission fees for opening a bank/card account and servicing are set in [accordance with the service tariffs for services provided to individuals by "AMIO BANK" CJSC](https://static.amiobank.am/files/cms/03_04_26_sakagin_ENG_3ac6f97325.pdf), which you can familiarize yourself with on the Bank's website in the "[Accounts](https://amiobank.am/en/accounts)" section. 
- The Bank returns the deposit amount or part of it to the Depositor at his or her first request. 
- In case of early termination of the deposit, the calculated, accrued and/or paid interest is recalculated at an annual interest rate of 0.01%, except for deposit types with the possibility of early termination. 
- In case of deposits with the possibility of early termination, interest is recalculated for the period from the date of conclusion of the Deposit Agreement to the day preceding the termination, applying the interest rate set for the given deposit type at the time of conclusion of the agreement for the period corresponding to the given period. At the same time, if the deposit with the possibility of early termination is terminated from the moment of investment up to the 30th day inclusive, then the interest is recalculated at an annual interest rate of 0.01%.
- In the event of early withdrawal of the Deposit, the accrued interest resulting from the recalculation of the interest paid to the Depositor before that date is deducted from the principal amount of the Deposit. 
- In the event that the Depositor does not request it after the expiration of the deposit term, the term of the Deposit Agreement is automatically extended at the annual interest rate and conditions applicable to the given Deposit at the time of extension, unless the automatic extension condition is specified in the Deposit Agreement and nothing else is provided for by the Deposit Agreement and the Information Summary. 
- The term of the Deposit Agreement shall not be extended if, at the time of extension of the Deposit Agreement, the Bank has terminated the attraction of the given Deposit type. In such a case, the Bank shall transfer the Deposit amount and interest to the Depositor’s account with the Bank. 
- **During the term of the Agreement, the Bank has the right to unilaterally change the terms of service of the Deposit in accordance with the requirements of the RA legislation, informing the Depositor about this in advance, at least 15 days before the change.**
- **The Bank shall have the right to change the amount of interest paid on the positive balance of funds in the Bank Account by informing the Depositor in writing, at least 15 days before the change, through its preferred means of communication, unless otherwise provided for in the Agreement. In case of extension of the Deposit Term, the calculation of days and interest on the deposit shall begin from the date of extension inclusive. **
- In case of extension of the deposit term, the calculation of days and interest on the deposit begins from the date of extension inclusive.
- If the Deposit deadline is a non-working day, the Deposit amount is returned/extended on the first working day following the non-working day, adding the interest calculated for non-working days to the interest calculated for the term specified in the Deposit Agreement.

Provisions for deposit formation, extension and termination

- The Depositor has the right to place the Deposit in favor of a third party. In case of placing a Deposit in favor of a third party, the person in whose favor the Deposit is placed must be an active client of the Bank. 
- **The Depositor is obliged to comply with the provisions of the RA legislation, the main (general) rules for attracting bank deposits from individuals and the Deposit Agreement. **
- **The Deposit is returned to the Depositor in the currency in which it was placed.**
- When receiving the Deposit, its part and (or) the interest accrued on it at the Bank's branches, the Depositor presents himself to the Bank with an identity document. You can familiarize yourself with the documents necessary for concluding a Deposit placement/bank/card account opening agreement, performing operations, settling the Deposit/bank/card account closure on the Bank's website www.amiobank.am in the "[List of documents for opening an account for RA resident individuals](https://static.amiobank.am/files/cms/Documents_list_bank_account_Arm_13122023_b835d88e18_2120097202.pdf)" section.
- **In case of a change in the address or name (surname) of the Depositor, a change in the documents confirming the person (identity), as well as changes in other personal data provided by the Depositor, the Depositor is obliged to inform the Bank within 5 (five) business days in order to implement the necessary changes, moreover, the Depositor is responsible for the consequences of not informing the Bank about the relevant changes within the above-mentioned period. The provisions of this clause also apply to a third party who has acquired the rights of the Depositor.** 
- **During the term of the Deposit Agreement, the Bank shall inform the Depositor of any changes to the terms of the Agreement, the rights, obligations, liability of the parties, the definition, amendment or termination of the liability, or any changes to the Bank’s internal acts that have any impact on the Deposit Agreement, which result in a change in the annual percentage yield, by means of communication with the Bank selected by the Depositor, at least 15 days prior to the date of the change in the annual percentage yield, and in the event of a unilateral change by the Bank in other information subject to mandatory provision to the Depositor, the information on the change shall be provided to the Depositor in the manner preferred by the latter after the decision on the relevant change is made, but no later than 7 business days before the change enters into force, except for the case of sending data to the credit bureau; in other cases, the change in the specified information shall be provided to the Depositor no later than 7 business days after the relevant change occurs and the Bank is informed.** 

**THE DEPOSITOR HAS THE RIGHT TO COMMUNICATE WITH THE BANK IN HIS PREFERRED WAY: BY POSTAL OR ELECTRONIC. RECEIVING INFORMATION ELECTRONICALLY IS THE MOST CONVENIENT. IT IS AVAILABLE 24/7, FREE FROM THE RISK OF LOSS OF PAPER INFORMATION AND ENSURES CONFIDENTIALITY.**

- **The Bank, being the tax agent of the Individual Depositor, makes deductions in accordance with the tax legislation of the Republic of Armenia. Income from deposits is subject to taxation at the rate of 10% (ten percent) of the interest accrued on the Deposit. **
- **In accordance with Article 6, Clause 2 of the RA Law “On Currency Regulation and Currency Control”, interest paid on financial transactions may be paid in AMD, as well as in the foreign currency in which the deposit was attracted, at the request of the Depositor.** 
- **During the formation, servicing and/or termination of the Deposit, the Bank, based on the customer due diligence requirement established by the RA Law “On Combating Money Laundering and Financing of Terrorism”, may request additional documents or other information based on the “Know your customer” principle, as well as ask additional questions to the Depositor during oral communication, as well as taking into account other various circumstances, the Bank may request additional documents and information from the Depositor.**
- **In accordance with the agreement signed with the United States on the basis of the Foreign Account Tax Compliance Act (FATCA), the Bank may collect additional information to determine the fact that the Depositor is a US taxpayer.** 
- **In accordance with the requirements of the Tax Code of the Republic of Armenia and the "Common Reporting Standard for the Automatic Exchange of Financial Account Information" (CRS), the Bank may collect and transfer certain information on the accounts and tax residency of non-resident clients to the State Revenue Committee of the Republic of Armenia. In case of failure to provide the required information to the Bank, the Bank, in accordance with the requirements of the Tax Code of the Republic of Armenia, will be forced to refuse (suspend) transactions with the Depositor's financial accounts, with the exception of transactions to transfer funds belonging to the Depositor to an account opened in the name of the Depositor at another financial institution or to provide funds to the Depositor in person.**

Other additional terms:

- *Cash deposits and accrued interest on them are provided without a commission fee of 0 AMD**
- **Non-cash deposits held in the deposit account for at least 180 days are provided without a commission fee of 0 AMD. In other cases, non-cash deposits are provided in accordance with [the service tariffs for services provided to individuals by “AMIO BANK” CJSC](https://static.amiobank.am/files/cms/03_04_26_sakagin_ENG_3ac6f97325.pdf) at the time of the transaction.**
- **At the request of the depositor, the following payment card of the “Mastercard” or “VISA” payment system is provided with free annual maintenance (hereinafter referred to as the Card):**

• **In case of deposit/s balances from 1,000,000 to 15,000,000 AMD or equivalent in foreign currency: MC Standard or Visa Classic payment card,**

• **In case of deposit/s balance of AMD 15,000,001 or more or its equivalent in foreign currency: MC Gold or Visa Gold payment Card*,** *

• **In case of a minimum deposit/s balance of 50,000,000 AMD or equivalent in foreign currency: Visa Platinum or MC World payment card.** *

***If the Depositor wishes, a Card of a lower class than the given card type may be provided instead of the specified card type, free of charge. One free card is provided within the framework of one deposit, in case of placing more than one deposit in the Bank under the same Depositor's name, a maximum of 2 free cards may be provided, and the cards must be in different currencies.
Non-resident individual customers are not provided with a card as part of the deposit.**

- **The card is provided free of charge, without a service fee, during the term of the Deposit Agreement.**
- **In case of repayment/early termination of the Depositor's current deposit(s), starting from the month following that date, the Bank has the right to apply an annual service fee for the Card at [the service tariffs for services provided to individuals by "AMIO BANK" CJSC](https://static.amiobank.am/files/cms/03_04_26_sakagin_ENG_3ac6f97325.pdf) at that time.**

- **Card reissue:**

• **In case of expiration of the card, during the validity period of the Deposit - free of charge (service fee and non-decreasing account balance - 0 AMD),**

• **In case of expiration of the deposit and non-extension of the deposit - in accordance with [the service tariffs for services provided to individuals by "AMIO BANK" CJSC.](https://static.amiobank.am/files/cms/03_04_26_sakagin_ENG_3ac6f97325.pdf)**

• **If the card was issued based on a closed deposit at the time of reissue, but at the time of reissue, another deposit is active in the customer's name, and if the card class corresponds to the current deposit balance, then the Bank has the right to reissue the card with free annual maintenance**

• **If the Depositor applies for reissue during the validity period of the deposit agreement upon receipt of the Card or upon expiration of the card, and if the Bank does not issue the card type(s) specified in this clause at the given time, then the Card type is determined in accordance with the conditions for term deposits currently operating in the Bank.**

Additional features

- There are no penalties for opening, servicing and closing a deposit account. 
- The Bank provides the client with account statements in accordance with the procedure and at regular intervals established by the legislation of the Republic of Armenia.

2.1.3 Certificates/statements regarding transactions received/sent via fast money transfer systems - 5,000 AMD
2.2 Provision of certificates/information by mail regarding account transactions or transactions performed without an account (including VAT) - 2.1 Tariff + postal service fee
2.3 Provision of a bank account certificate and a copy of a SWIFT message (including VAT) - 1,000 AMD

Information about tariffs and penalties

- **According to the RA Law “On Guaranteeing the Compensation of Bank Deposits of Individuals”, the compensation of bank deposits of individuals (including individual entrepreneurs) in banks operating in the territory of the RA is guaranteed by the Deposit Guarantee Fund. **
- **Both dram and foreign currency deposits of the depositor are guaranteed. The following amounts of guaranteed deposits are defined by the law: **
• **if the depositor has only a dram bank deposit in an insolvent bank, then the amount of the guaranteed deposit is sixteen million Armenian drams,**
• **if the depositor has only a foreign currency bank deposit in an insolvent bank, then the amount of the guaranteed deposit is seven million Armenian drams,**
• **if the depositor has dram and foreign currency bank deposits in an insolvent bank, and the amount of the dram bank deposit is more than seven million Armenian drams, then only the dram deposit is guaranteed, up to sixteen million Armenian drams,**
• **if the depositor has dram and foreign currency bank deposits in an insolvent bank, and the amount of his dram bank deposit is less than seven million Armenian drams, then the dram bank deposit is guaranteed in full and the foreign currency bank deposit is guaranteed in the amount of the difference between seven million drams and the compensated dram bank deposit.**

- **All dram deposits of a depositor in the same bank are considered one deposit and all foreign currency deposits of a depositor in the same bank are considered one deposit.**

- **If the depositor has a separate bank deposit in an insolvent bank and at the same time is the owner of a joint bank deposit in the same bank, then the sum of his separate bank deposit and his share in the joint bank deposit is guaranteed, in the manner and to the extent prescribed by this Law.**
- **If the depositor has a problematic liability towards an insolvent bank, then the amount subject to compensation is calculated based on the calculated positive difference between the bank deposit and the problematic liability, in the manner and to the extent prescribed by this Law.**

- **A bank deposit is not considered a guaranteed deposit if:՝**
• **which belongs to the head of the given bank and (or) his family members,**
• **which belongs to a person with a significant stake in the given bank and (or) his family members,**
• **whose owner (co-owner) has renounced the right of ownership to his share,**
• **which has been recognized as a monetary instrument obtained through criminal means in accordance with the procedure established by law and other legal acts, unless its owner proves otherwise,**
• **which has been invested in the given bank at an interest rate at least 1.5 times higher than the interest rate for similar bank deposits provided for in the offer to conclude a public contract by the given bank at the time of investment of the bank deposit.**

Guaranteed deposit amounts

- **Any disputes and disagreements arising between the parties during the term of the deposit agreement shall be resolved through negotiations between the parties, and in the absence of such agreement, in accordance with the procedure established by the legislation of the Republic of Armenia.**
- **The Bank shall examine the Depositor’s complaint/claim if it has been submitted within one year from the moment the Depositor became aware or could have become aware of the violation of their rights.** 
- **The Bank shall provide a final response to the Depositor’s complaint within 10 (ten) business days. If the Bank’s response does not satisfy the Depositor, the latter may, within six months, apply to the Financial System Mediator in accordance with the Law of the Republic of Armenia “On the Financial System Mediator,” or apply to the court in accordance with the procedure established by law**.


Dispute Resolution Procedure and Protection of Depositor Rights.

- Annual nominal interest rate: the interest rate defined by the deposit agreement on an annual basis, according to which the Bank calculates the interest amounts payable to the depositor.

**_Example 1_**. Deposit “Profitable” (without the possibility of replenishment or withdrawal)

- **Deposit amount** - 100,000 AMD
- **Term** - 367 days
- **Method of interest payment** - At the end of the term
- **Annual simple interest rate** - 9.5%
- **Deposit placement date** - 01.10.2021
- **Deposit maturity and interest payment date** - 02.10.2022
- **Interest payable (not calculated on the deposit payment date)** - 100,000*9.5/100/365*366 = 9,526.02 AMD
- **Income tax** - 10%
- **Interest payable after taxation** - 9,526.02 - 9,526.02*10/100 = 8,573.42 AMD

**_Example 2_**. Deposit "Profitable" (with the possibility of replenishment)

- **Deposit amount** - 10,000 US dollars
- **Term** - 181 days
- **Method of interest payment** - At the end of the term
- **Annual simple interest rate** - 3.35%
- **Deposit placement date** - 01.10.2021
- **Deposit maturity and interest payment date** - 31.03.2022
- **Interest payable (not calculated on the deposit payment date)** - 10,000*3.35/100/365*180 = 165.21 US dollars
- **Income tax** - 10%
- **Interest payable after taxation** - 165.21-165.21 *10/100 = 148.68 US dollars

Benefits

Where after contractual time the depositor does not require to pay the amount of a term deposit or after the occurrence of circumstances specified under agreement the depositor does not require to repay the deposit amount lodged on other terms and conditions, the agreement shall be deemed to have been prolonged on the terms of a demand deposit, unless otherwise stipulated by the contract.

The bank may not unilaterally reduce the interest rate defined by the agreement of bank deposit that a citizen lodged intending to receive back after certain period of time or occurrence of circumstances stipulated in the agreement, unless otherwise provided by law.

The refund in the banks of the Republic of Armenia of bank deposits attracted from individuals (sole entrepreneurs alike) is guaranteed by Armenian Deposit Guarantee Fund.
